Fortunately, the risks associated with COVID-19 and the Omicron variant have lessened, along with the public safety requirements set forth in the CDC’s guidelines. However, reasonable precautions and care for the health and safety of our members and guests should still be taken and risks of communicable diseases still exist.

As a result, by using any of the Association’s community facilities, including, without limitation, the Clubhouse, Pool and all Recreational Facilities (the “Facilities”), each member and/or guest of a member (collectively, the “User”) acknowledges and agrees: (1) that an inherent risk of exposure to COVID-19 exists in any public place where people are present; (2) to assume all risks that a User may be exposed to or infected by COVID-19 while using the Facilities; (3) that the Association and its officers, directors, employees, volunteers, contractors, servants, sponsors, agents, representatives, successors, heirs and assigns (collectively “Releasees”) shall not be liable for any risks, injuries, illness, infections, death or damages arising out of the User’s use of the Facilities; and (4) to RELEASE, WAIVE, DISCHARGE, INDEMNIFY AND HOLD HARMLESS, DEFEND and COVENANT NOT TO SUE, on behalf of the User and his or her personal representatives, heirs and assigns, any or all of the Releasees for any injuries, illness, infections, death or damages and/or any claims, demands, losses or liabilities arising from or related to the User’s use of the Facilities.

The foregoing waiver and release requirements with respect to the use of the Facilities shall be effective immediately. Thank you for your cooperation and continuing interest in the well-being of our community and its members.
